Terms of Use

Article 1: Applicability and Binding Force

These terms constitute a complete and legally binding contract between you ("the User") and NextGen. By accessing our services, you expressly and unconditionally agree to be bound by these terms.

Article 2: Nature of Services (Execution Only)

NextGen provides an advanced technical infrastructure for data aggregation and analytical indicators.

2.1. No Regulated Advice: We act exclusively as an independent technology provider. We do not provide regulated financial advice, investment brokerage, or portfolio management as defined by the Financial Markets Authority (AMF).

2.2. Autonomy: Any financial decision executed by the User is made entirely at their sole discretion and exclusive risk.

Article 3: Legal Risk Disclosure

The User explicitly acknowledges:

Extreme volatility: Financial markets and digital assets are subject to unpredictable price fluctuations.

Capital loss: Trading involves an inherent risk of partial or total loss of invested capital.

No guarantee: Historical data and algorithmic probabilities offer no assurance of future profitability.

Article 4: Intellectual Property

The entire infrastructure, including data models, source codes, and algorithms, is the exclusive property of NextGen. Any reverse engineering or automated extraction (scraping) is strictly prohibited.

Article 5: Limitation of Liability

To the maximum extent permitted by French law, NextGen shall not be held liable for technical interruptions, API latency, or inaccuracies in third-party data feeds, nor for Force Majeure events, including massive cyberattacks or failures of national public services.

Article 6: Applicable Law and Jurisdiction

This contract is exclusively governed by French law. Any dispute not settled amicably shall be submitted to the exclusive jurisdiction of the courts of Lyon, France.
